Top Five Friday!!! Colorado – Equal Pay for Equal Work Act – effective 1/1/21

1. The Act prohibits employers from engaging in gender discrimination by paying one gender more than the other for “substantially similar work.”

2. "Substantially similar work" means the skill, effort, and responsibility are pretty much the same for the positions at issue (regardless of title).

3. Pay differences are permitted if they are based on: merit, production, geographic location, education, training, experience (related to the work), and travel requirements.

4. Employers are required to provide notice to all Colorado employees about promotional opportunities – regardless of job location.

5. Job postings for positions which may be performed in Colorado, or remotely from any location, are required to have compensation information: salary range, bonus/commission, and benefits.
